“On October 18, 2023, a grand jury in the U.S. District Court for the District of Utah indicted Jonathan J. Dunn for interfering with the crew of a commercial airline flight” the statement from the Office of Inspector General at the U.S. Department of Transportation read.

“The indictment alleges that, on or about August 22, 2022, Dunn, the crew’s First Officer, interfered with the performance of a crew member by using a dangerous weapon to assault and intimidate the Captain

“Dunn was authorized to carry a firearm through the Transportation Security Administration’s Federal Flight Deck Officer program.

“After a disagreement about a potential flight diversion due to a passenger medical event, Dunn told the Captain they would be shot multiple times if the Captain diverted the flight.

“DOT-OIG is conducting this investigation with the Federal Bureau of Investigation with substantial assistance from FAA,”

The two-page indictment, obtained by CBS News Tuesday, alleges that Dunn “did assault and intimidate a crew member of an aircraft…and did use a dangerous weapon in assaulting and intimidating the crew member.”

On Wednesday, multiple sources confirmed to CBS News that Dunn was also the plaintiff in an unsuccessful U.S. Supreme Court case last year in which — as a lieutenant colonel in the U.S. Air Force — Dunn attempted to block the Air Force from disciplining him for refusing to take the mandatory COVID-19 vaccine on religious grounds.

In April 2022, the high court ruled against Dunn’s request for a religious exemption by a 6-3 margin.

According to court documents, Dunn was commissioned in the Air Force in 2003, and flew two combat tours in Afghanistan. He left active duty in 2014 and joined the Air Force Reserve.

In August 2021 he was given command of the 452nd Contingency Response Squadron, court documents read. However, after refusing to get vaccinated, he was relieved of duty in February 2022.

In a statement Tuesday evening, a spokesperson for the Transportation Security Administration told CBS News, “TSA is aware of an incident involving a Federal Flight Deck Officer.”

The agency says Dunn has been removed from the FFDO program, but could not comment further due to the “pending investigation.”

Delta told CBS News in a statement Tuesday evening that Dunn was no longer employed by the airline and refrained from commenting further pending the investigation.

“Out of respect for the ongoing aviation authority investigation of this incident, Delta will refrain from commenting on this matter but will confirm that this First Officer is no longer employed at Delta,” the airline said in a statement Wednesday.

Jonathan Dunn’s last known address was in Marysville, California, about 40 miles north of Sacramento.

His medical certificate, which the Federal Aviation Administration requires for active pilots, has been suspended by the FAA.

The Air Line Pilots Association, the union that represents Delta pilots, told CBS News in a statement Wednesday that the “security of our crews and passengers is our highest priority,” and said the suspect’s alleged “action is wholly inconsistent with that mission,” also calling it “at odds with our union’s professional code of conduct and a violation of the trust instilled in us by those we serve.”

Felicia Martinez, a spokesperson for the U.S. Attorney’s office for the District of Utah, also told CBS News in a statement that “at this stage in the case, we don’t have a lot of information to share without jeopardizing the integrity of the case.”

Jonathan Dunn is scheduled to be arraigned on Nov. 16.

A former Delta co-pilot has been indicted after allegedly ‘threatening to shoot the captain of a commercial flight’ after a disagreement about a potential flight diversion.

Jonathan J. Dunn was indicted by a grand jury in the U.S. District Court of Utah for allegedly interfering with the crew of a commercial airline flight.

According to legal documents, Dunn, who is said to be from California, used a dangerous weapon to assault and intimidate the Captain of the flight.

Dunn had been authorized to carry a firearm through the Transportation Security Administration’s Federal Flight Deck Officer Program.

No motive for Dunn’s alleged behavior has been offered.

The inspector general did not identify the airline on which the incident occurred, saying only that it was a commercial airline flight.

The office did not give the flight’s intended route, or whether it was diverted.

A spokesperson for Delta Air Lines confirmed to CBS News that Dunn was working for Delta when the alleged incident took place but that he is no longer employed by the company.

The inspector general said it was working with the FBI and the Federal Aviation Administration on the investigation.

The incident involving Jonathan Dunn actually occured a few days before Joseph Emerson, an off-duty Alaska Airlines pilot riding in the cockpit jump seat tried to shut down the engines of a Horizon Air jet in midflight.

Joseph Emerson also known as Joe Emerson rose to public prominence in October 2023 after he allegedly attempted to shut off an Alaska airline plane’s engines mid-flight and presumably crash it.

He was restrained and handed over to Port of Portland police after the plane made a forced landing at Portland.

Flight 2059 was flying from Everett, Washington to San Francisco when the incident occurred.

Alaska Airlines addressed the isssue in a statement.

According to the statement, a regional carrier under Alaska Airlines, Horizon, faced a threat during a flight Sunday.

The crew reported “a credible security threat related to an authorized occupant in the flight deck jump seat.”

This referred to Joseph David Emerson who had attempted to turn off the plane’s engines from his jump seat position behind the pilots.

Usually, off-duty airline pilots sit in the jump seat of the flight deck behind the pilots to fly back to their home base if seats are available.

“The jump seat occupant unsuccessfully attempted to disrupt the operation of the engines,” the airline said in the statement.

“The Horizon Captain and First Officer quickly responded, engine power was not lost and the crew secured the aircraft without incident.”

The pilots of the airplane also addressed the incident via audio of the plane’s cockpit communications.

“As a heads up. We’ve got the guy that tried to shut the engines down out of the cockpit. It doesn’t sound like he’s got any issue in the back right now. I think he’s subdued,” the pilot of the plane told air traffic control.

“Other than that we want law enforcement as soon as we get on the ground and parked.”

Law enforcement from Port of Portland police were on hand to arrest David Emerson immediately the flight landed.

He was booked on charges of 83 counts of attempted murder, a felony, and 83 counts of reckless endangerment.

He also faces a count of endangering an aircraft.
